Terms of Use

1. Acceptance of Terms

By using Capsly (the app or the web), you accept these Terms of Use and the Privacy Policy. If you do not accept them, please do not use the service.

2. Creating an Account

• You must be at least 13 years old to create an account.
• You are responsible for providing accurate and up-to-date information at registration.
• You are responsible for keeping your password confidential and for all activity under your account.
• Sharing your account with anyone else is prohibited.

3. Content and License

Videos, titles, and other content you upload to Capsly ("User Content") remain yours. To enable us to provide the service, you grant us the following limited license:

• To store, copy (for backups), transcode, and distribute the content on our platform (via CDN).
• To display the content to the users determined by your visibility setting (public / followers / direct).
• This license remains in effect while the content exists on the platform. However, because published videos on Capsly are immutable (cannot be deleted or edited), they cannot be withdrawn once they go live.

You are responsible for ensuring that your content is lawful, does not infringe on the rights of third parties, and complies with applicable law.

4. Prohibited Behavior

The following content and behavior are strictly prohibited on Capsly:

• Posts that contain violence, hate speech, or discrimination
• Sexual exploitation of children or content that endangers them
• Sharing content belonging to others without permission (copyright infringement)
• Non-consensual disclosure of personal data (private life, location, contact details)
• Fake accounts, bots, and manipulative engagement (vote/prediction fraud)
• Technical attacks against the platform (scraping, DDoS, exploits)
• Promotion of illegal goods or services
• Misleading and harmful disinformation

5. Suspension and Termination

• If you are found to be in breach of these terms, your account may be suspended or terminated without notice.
• You may delete your account at any time via "Settings → Delete My Account". A 30-day grace period applies.
• If you do not reactivate during that period, your data is permanently deleted.

6. Intellectual Property

The Capsly logo, design, software code, and all related intellectual property rights belong to the Capsly team. They may not be reproduced, and no derivative works may be created, without express written permission.

7. Limitation of Liability

• The service is provided "as is". No guarantee of uninterrupted or error-free operation is given.
• Capsly is not responsible for User Content; the uploading user bears responsibility.
• To the fullest extent permitted by law, no liability is accepted for indirect, incidental, or consequential damages (such as loss of data or profits).

8. Changes to the Terms

We may update these terms from time to time. For material changes we notify you via in-app notice or email. Continued use of the service after changes take effect constitutes acceptance of the new terms.

9. Governing Law

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over any disputes. Local consumer protection rights of users residing in the European Union are reserved.
